These terms and conditions ("Terms") govern the use of services made available on or through the "All Time Buddy" platform, including the website https://alltimebuddy.com/ and the "All Time Buddy" mobile application (collectively, the "Platform"), and any services provided therein (the "Services"). These Terms also incorporate our Privacy Policy https://alltimebuddy.com/privacy policy and any supplemental terms or policies issued from time to time ("Supplemental Terms"). In case of a conflict between these Terms and the Supplemental Terms, the latter will prevail.
By accessing or using the Platform, you agree to these Terms. If you do not agree, you must not use the Platform or the Services. Please review these Terms carefully.
1. Services
1.1 Nature of Services: The Platform connects users with independent service providers ("Service Providers") for various tasks, errands, and assistance services ("Buddy Services"). All Time Buddy acts solely as a facilitator for these engagements and does not provide the actual services rendered by Service Providers.
1.2 Limitation of Responsibility: All Time Buddy is not responsible for the quality, safety, legality, or performance of the services provided by Service Providers. All engagements are directly between users and Service Providers.
1.3 Platform Usage: The Platform is intended for personal, non-commercial use unless otherwise agreed upon in writing. Services are currently available only within Bhopal. Users outside this jurisdiction may have limited access to services.
2. Account Creation
2.1 Eligibility: To create an account, you must be at least 18 years old and capable of entering into a legally binding agreement.
2.2 Account Responsibility: You are responsible for maintaining the confidentiality of your account credentials and all activities under your account. Notify us immediately of any unauthorized use or security breach.
2.3 Information Accuracy: All information provided during account creation must be accurate and up to date. Failure to provide accurate information may result in account suspension or termination.
3. Booking Services
3.1 Process: Bookings can be made via the Platform by providing required details about the requested Buddy Services. Confirmation will be sent via whatsapp or call.
3.2 Cancellations: Users may cancel bookings prior to confirmation without charges. Post-confirmation cancellations may incur a fee as outlined in the cancellation policy.
3.3 Substitution: In the event of a Service Provider’s unavailability, All Time Buddy may assign a substitute Service Provider.
4. Pricing and Payment
4.1 Charges and Fees: Charges for Buddy Services will be displayed during booking. Fees may include service charges, convenience fees, or other applicable costs. Taxes are included in the total amount unless stated otherwise.
4.2 Payment Methods: Payments can be made via credit cards, debit cards, net banking, UPI, or approved digital wallets. Payment upon service completion ("cash on completion") may not be available for all bookings.
4.3 Refunds: All payments are non-refundable unless otherwise determined by All Time Buddy or required by law.
5. User Conduct
5.1 Prohibited Actions: Users shall not:
Engage in fraudulent, abusive, or illegal activities.
Discriminate against Service Providers on any basis protected by applicable laws.
Solicit Service Providers to perform services outside the Platform.
5.2 Safe Environment: Users must ensure a safe and respectful environment for Service Providers. All Time Buddy reserves the right to suspend or terminate accounts for violations.
6. User Content
6.1 Content Rights: By submitting content (e.g., reviews, feedback) on the Platform, you grant All Time Buddy a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content for promotional and operational purposes.
6.2 Prohibited Content: Users must not upload content that is defamatory, harmful, or violates the rights of any party.
7. Privacy and Data Use
7.1 Data Collection: All Time Buddy collects and processes user data as outlined in the Privacy Policy. By using the Platform, you consent to this data collection and usage.
7.2 Third-Party Sharing: Data may be shared with Service Providers or third-party partners as required to facilitate services. All Time Buddy is committed to safeguarding user data.
8. Intellectual Property
8.1 Ownership: All intellectual property on the Platform, including trademarks, logos, and software, is owned or licensed by All Time Buddy. Users are granted a limited, non-transferable license to use the Platform for personal purposes.
8.2 Restrictions: Users may not reproduce, distribute, or modify any content from the Platform without prior written consent.
9. Liability and Disclaimers
9.1 Platform Disclaimer: The Platform and Services are provided "as is" without warranties of any kind. All Time Buddy disclaims all liability for errors, interruptions, or unavailability of the Platform.
9.2 Limitation of Liability: To the fullest extent permissible by law, All Time Buddy’s liability for any claims is limited to INR 10,000 or the amount paid for the disputed service, whichever is lower.
10. Indemnity
Users agree to indemnify All Time Buddy against any claims, damages, or liabilities arising from misuse of the Platform or violation of these Terms.
11. Governing Law and Dispute Resolution
11.1 Jurisdiction: These Terms are governed by the laws of Bhopal. Any disputes will be subject to the exclusive jurisdiction of courts in Bhopal.
11.2 Arbitration: Disputes may be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Bhopal.
12. Miscellaneous
12.1 Amendments: All Time Buddy reserves the right to modify these Terms at any time. Changes will be effective upon posting on the Platform.
12.2 Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.
12.3 Force Majeure: All Time Buddy is not liable for delays or failures caused by events beyond its reasonable control.
